Combar Agreement For The Supply Of Legal Services

Chambers members will also provide, upon request, their services to authorised persons in 2012, in accordance with the standard terms of the contract for the provision of legal services by barristers, which can be found under www.barcouncil.org.uk/media/185511/contractualterms.pdf unless otherwise agreed in writing, chamber members will offer their services and receive instructions on basis A, in accordance with the general terms and conditions of sale of legal services by barristers to Solicitors in Commercial Matters, as agreed between the Commercial Bar Association and the City of London Law Society, version 3.0 2018 ("COMBAR Terms"). However, the CLLS would not agree that, in all cases, lawyers should assume direct responsibility for the payment of lawyers` fees. As a result, we would expect barristers and solicitors who, from 25 May 2018, enter into new contracts based on the terms, to enter into a version 3 contract (unless they are replaced). Faced with the controversy over the contractual terms proposed by the Bar Council and recognising that it would be costly and time-consuming for Barristers to design alternative terms for the provision of services by Barristers, the Commercial Bar Association (COMBAR) and the City of London Law Society ("CLLS") have entered into standard contractual agreements. With effect from 1 January 2014, COMBAR and CLLS have published an updated draft of the conditions, based on practical experience in the use of the terms, clarifying the effect of certain concepts and reflecting certain regulatory changes (including the replacement of the Code of Conduct).
